1. Acceptance of Terms

By accessing or using SmartSwing ("the Service"), operated by Adretix Inc., you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2. Description of Service

SmartSwing is an AI-powered automated swing trading platform that connects to your Alpaca brokerage account to execute trades based on algorithmic strategies. The Service includes portfolio tracking, strategy management, AI market analysis, and trade execution capabilities.

3. Not Financial Advice

SmartSwing does not provide investment advice, financial advice, trading advice, or any other sort of advice. The Service is a research and automation tool. All trading decisions made by the system are based on algorithmic signals and AI analysis, which may be incorrect. You are solely responsible for your trading decisions and any financial outcomes.

4. Account Responsibilities

  • You must be at least 18 years old to use the Service
  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activity under your account
  • You must provide accurate Alpaca API credentials
  • You must not share your account with others

5. Trading Risks

Automated trading carries inherent risks. You acknowledge and accept that:

  • You may lose some or all of your invested capital
  • Past performance of any strategy does not guarantee future results
  • AI-generated signals and analyses may contain errors
  • Market conditions can change rapidly and unexpectedly
  • System outages, bugs, or delays may affect trade execution

6. Limitation of Liability

To the fullest extent permitted by law, Adretix Inc. shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service, including but not limited to trading losses, lost profits, or data loss.

7. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. You may delete your account at any time through Settings.
